Vallee | Terms of Sale

These terms apply to purchases of Vallee baths, basins, tables and custom-made products. Your accepted quote or order confirmation sets out the specific product, specifications, price, deposit, freight and estimated lead time for your order.

Orders, deposits and payment

A deposit stated in your quote secures your order and place in the production queue. Production will not begin until the full order price has been paid, unless Vallee agrees otherwise in writing. Any remaining balance must be paid by the due date on your invoice and, in all cases, before dispatch or collection.

Custom orders are made to the specifications approved by you in writing. Please check dimensions, colour, finish, waste position and other details carefully before approving your order. Changes requested after approval may change the price and lead time.

Handmade material and natural variation

Vallee products are individually handmade from concrete. Natural variations in tone, texture, pinholes, edges and surface character are part of the material and making process. Product photos, samples and screens are indicative; the finished piece may vary from them.

These variations are not faults where the piece remains reasonably consistent with its agreed description and specifications. This does not limit your rights if a product fails to meet a consumer guarantee or differs materially from what was agreed.

Cancellations

There is no change-of-mind return or cancellation right for an order that has been made to the agreed specifications, except where required by law.

If you ask to cancel an order, Vallee may deduct reasonable, evidenced costs and losses incurred because of the cancellation, such as completed work, custom materials ordered, supplier charges and reasonable losses where the product cannot readily be resold. Any remaining amount paid will be refunded. If those reasonable costs and losses exceed the deposit, you may be responsible for the difference. Your deposit is not automatically forfeited.

Inspection, delivery, storage and responsibility after delivery

Freight charges and delivery arrangements are confirmed with your order. You must ensure that the delivery location is suitable, accessible and ready to receive and safely store the product.

You must inspect the product promptly on delivery and record any visible transit damage on the delivery paperwork. You must also notify Vallee as soon as reasonably practicable, preferably within 48 hours, of any damage, shortage or other issue identified on delivery. Please provide photographs of the packaging, delivery area and product where relevant.

After delivery, you are responsible for protecting and safely storing the product until it is installed. This includes keeping it in a secure, dry and suitable location, protected from rain, flooding, moisture, dirt, chemicals, construction materials, impact, abrasion, staining, freezing conditions, excessive heat and unauthorised handling. The product must remain in its original protective packaging where reasonably practicable and must not be stacked, dragged, placed directly on an unsuitable surface or used as a work surface.

The product must be handled, moved and stored only in accordance with any instructions provided by Vallee. You must ensure that any builder, installer, contractor, delivery provider or other person who handles the product is given those instructions and takes appropriate precautions.

If installation is delayed after delivery, you must arrange suitable ongoing protection and storage at your cost. Vallee may charge reasonable additional costs arising from delayed delivery, re-delivery, storage, handling or attempted delivery where those costs result from the site not being ready or the product not being able to be safely delivered.

Vallee is not responsible for damage, deterioration, staining, cracking, chipping, movement or other loss caused after delivery by inadequate storage, exposure, site conditions, construction activity, incorrect handling, installation, modification, use, neglect or failure to follow Vallee’s instructions. This does not exclude or limit any rights you have under the Australian Consumer Law, including rights relating to a problem that existed before delivery or was caused by Vallee or its delivery arrangements.

Signing for delivery does not remove your rights under Australian Consumer Law, including for problems that could not reasonably be identified at delivery. However, signing for delivery, failing to record visible damage or failing to notify Vallee promptly may make it more difficult to determine when or how the damage occurred.

Consumer rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee or other right that cannot lawfully be excluded. If a product has a problem, contact Vallee with your order details and a description or photos of the issue. We will assess it and provide any remedy required by law.
